The city of St. George and LRK LLC have reached a partial agreement in a lawsuit challenging the city’s zoning regulations and incorporation date.
Attorneys for both sides submitted a joint stipulation Wednesday dismissing, for now, the portion of the lawsuit seeking a determination of when St. George was legally incorporated, WBRZ reports. That issue was dismissed without prejudice, meaning it could still be revived later on.
The remaining dispute centers on zoning requirements tied to a proposed 120,000-square-foot veterans outpatient clinic near the intersection of Pecue Lane and Rieger Road.
The St. George City Council agreed Tuesday to hold a public hearing Sept. 30 on zoning changes related to the project, according to WBRZ. LRK attorney Loren Kleinpeter told the station that once the zoning ordinances are updated, the clinic can apply for a permit and begin construction.
LRK sued St. George earlier this year, challenging zoning changes affecting property tied to the proposed development and arguing that the city had not completed all of the legal steps required for incorporation.
Attorneys for both sides were unable to be reached for comment.
