The council will try again on May 14. At issue is a First Circuit Court of Appeals ruling in March that the property initially was improperly zoned as a TND. Developer Tommy Spinosa told the council that 40 property owners remain in limbo by the ruling, unable to close on loans. Meanwhile, Alex St. Amant, a lawyer representing area residents who oppose the development, blamed council members for the court’s decision and threatened to personally sue them.
