A final conference is planned later this month to determine whether an apartment complex, developers and a sewer treatment firm can reach a settlement over sewer discharge into the Cedar Lodge pond off Corporate Boulevard.

The case dates back to 2013, when Phil Witter and his company, Cedar Lodge Plantation, sued the owners of Fairway View Apartments, alleging the complex was periodically discharging massive amounts of raw sewage into the pond, planned as the centerpiece of a large-scale retirement community development.

Recent filings indicate the deal planned by Cedar Lodge Plantation and Harvest Partners has since fallen through, noting that questions remain as to whether the alleged contamination was a factor. Evidentiary hearings in the case began Nov. 4.

What’s being described in the latest court filing as a final settlement conference is set for Nov. 28. At least six other settlement attempts dating back to November 2014 have failed to produce an agreement.
