John S. Baker, an LSU Law School professor, and Elliott Stonecipher, a Shreveport demographer and political analyst, have written an op-ed for the Wall Street Journal arguing that the 2010 Census is unconstitutional, because it will count illegal immigrants. The census forms planned for use don’t ask people if they are citizens of the U.S. Baker and Stonecipher say this will cause states such as California and Texas to end up with more House seats than they should, because of the millions of illegal immigrants who live there, and penalize states such as Louisiana, which will lose seats during Congressional redistricting. “The census has drifted far from its constitutional roots, and the 2010 enumeration will result in a malapportionment of Congress,” they say.
