While construction is proceeding at the Greens at Millerville, a 53-acre mixed-use development at Interstate 12 and Millerville Road, developer Windey Gladney’s long-running legal battle with the bank that financed the project, Bancorp South, is headed back to the 19th Judicial District Court.
Earlier this month, the Louisiana Supreme Court refused to take up the case, which involves a series of suits and countersuits between Gladney and the bank over $2 million in construction loans. In May 2013, the District Court ruled in favor of Gladney, throwing out the bank’s claims against the developer and its defenses to counterclaims he filed against the bank.
The state 1st Circuit Court of Appeals reversed that ruling, prompting Gladney’s attorney to file writs with the Louisiana Supreme Court. Now that the high court has decided not to take up the matter, the case will go back to the District Court for a trial, which could be held later this year.
