In the eyes of the Department of Labor (DOL), all employees should be paid minimum wage and time and one half for all hours over 40 in a work week, unless an employee qualifies for an exemption from the base rule previously described. Exemptions are: executive, administrative, professional, computer and outside employees. Each of these exempt categories comes with its own list of qualifying criteria that must be met. Employers often use the salary method to pay their employees without looking at these qualifying criteria.
